1. Acceptance of Terms
Welcome to DailyChinese Pro ("we," "us," "our," or "the Service"). By creating an account, accessing, or using our website at dailychinese.pro, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
These Terms constitute a legally binding agreement between you and DailyChinese Pro. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.
2. Service Description
DailyChinese Pro is an online Chinese language learning platform that provides:
- Daily Chinese phrases with native audio pronunciation and pinyin
- Access to 365 expert teacher profiles and educational content
- Classic Chinese literature collections, including 山海经 (Classic of Mountains and Seas) with 242 stories and 3,100+ learning segments
- Interactive vocabulary building with 365,000 curated entries
- Contemporary Chinese culture and educational articles
- One-on-one practice sessions with teachers ($1 per session)
- Monthly subscription with 7-day free trial ($9.9/month)
3. User Accounts
3.1 Account Creation
To access most features, you must create an account by providing a valid email address, name, and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.2 Account Security
You agree to:
- Use a strong, unique password
- Notify us immediately of any unauthorized use
- Not share your account with others
- Not create multiple accounts to abuse free trials
3.3 Age Requirement
You must be at least 13 years old to create an account. If you are under 18, you need parental or guardian consent.
4. Subscription & Billing
4.1 Free Trial
New subscribers receive a 7-day free trial. During the trial, you have full access to all content. You may cancel at any time during the trial period and will not be charged.
4.2 Monthly Subscription
After the trial, your subscription automatically renews at $9.90/month until cancelled. Billing occurs on the same day each month.
4.3 Payment Processing
Payments are processed securely through Stripe. We do not store your credit card information on our servers. By subscribing, you authorize us to charge the recurring monthly fee to your designated payment method.
4.4 Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing cycle. You retain access until the cycle ends.
4.5 Price Changes
We may adjust subscription prices with at least 30 days' notice. Existing subscribers will be charged the new rate on their next renewal date after the notice period.
5. $1 Practice Sessions
In addition to your subscription, you may book individual practice sessions with teachers for $1.00 USD per session. These sessions are:
- Charged separately from your monthly subscription
- Non-refundable once the session is completed
- Subject to teacher availability
- Limited to reasonable usage (max 10 sessions per day per user)
6. Refund Policy
6.1 Free Trial Period
No charges during the 7-day free trial. Cancel anytime before the trial ends to avoid charges.
6.2 Monthly Subscriptions
Monthly subscription fees are non-refundable once charged. If you cancel mid-cycle, you retain access until the end of the billing period.
6.3 Practice Sessions
$1 practice session fees are refundable if the session is cancelled at least 24 hours before the scheduled time. Completed sessions are non-refundable.
6.4 Technical Issues
If you experience a verified technical failure that prevents you from using the Service for an extended period, contact us at support@dailychinese.pro for a prorated credit or refund.
7. User Content & Conduct
7.1 Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Harass, abuse, or discriminate against teachers or other users
- Share, copy, or redistribute copyrighted content from the Service
- Use automated tools (bots, scrapers) to extract content
- Attempt to circumvent paywalls or access controls
- Upload malware or malicious code
7.2 User-Generated Content
If the Service allows you to submit content (e.g., notes, comments), you grant us a non-exclusive license to use, store, and display that content within the Service. You retain ownership of your content.
8. Intellectual Property
All content on DailyChinese Pro, including but not limited to text, audio, images, teacher profiles, lesson plans, and software, is owned by DailyChinese Pro or its licensors and is protected by copyright, trademark, and other intellectual property laws.
The "每" logo, "DailyChinese Pro" name, and all related branding are trademarks of DailyChinese Pro. You may not use our trademarks without prior written consent.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- Learning outcomes will meet your specific expectations
- Teacher availability will match your schedule
- Content is always accurate or up-to-date
10. Limitation of Liability
To the maximum extent permitted by law, DailyChinese Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.
11. Termination
We may suspend or terminate your account if you violate these Terms. You may close your account at any time. Upon termination, all subscriptions end immediately, and no refunds are provided except as stated in our Refund Policy.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
